News article on Bush healthcare priorities cites McClellan, Kessler study on malpractice caps

A Nov. 16 Associated Press article, on President Bush's goal of limiting jury awards in medical malpractice cases as one of his key healthcare priorities, references a 1996 study by CHP/PCOR faculty Mark McClellan and Daniel Kessler which showed that spending for hospital care was lower in states with caps on malpractice verdicts. The article cites other studies, however, that have found little or no evidence of a link between costs and limits on liability. It also quotes health policy experts who voice concerns about the inadequacy of Bush's other strategies for containing healthcare costs, such as encouraging more consumer choice and responsibility, and giving tax breaks allowing people to buy individual health insurance plans. The Associated Press article was published in more than a dozen U.S. newspapers.
